Acceptable Use Policy

This is a legal agreement between you, the customer or user; and SpamFilteredForms.com, a wholly-owned subsidiary of RJM Web Design. By subscribing to or using this service, you signify your acceptance of the terms of this agreement, including any  amendments that may be made from time to time.

DESCRIPTION OF THE SERVICE

SpamFilteredForms.com provides a service by which individuals and businesses can receive spam-filtered email messages from the general public via a Web interface.

As part of this service, you understand that SpamFilteredForms.com will attempt to filter out submissions from form-filling robots, using proprietary software that examines each submitted message for characteristics typical of machine-generated form submissions. The goal is to significantly reduce the number and  frequency of machine-generated commercial text messages, commonly  known as "spam" messages. You also agree and acknowledge that our spam-filtering services may be less than 100 percent effective and represent a "best-effort" service.

IMPORTANT: THIS IS BETA SOFTWARE

By signing up for and/or using this service, you acknowledge and accept that this service is powered by Beta software. By definition, Beta software is experimental and is still in a testing phase. It may contain bugs, errors, omissions, and possibly security vulnerability. Bu using this service you are agreeing to be part of out Beta testing program and agree to hold harmless RJM Web Design, our hosting company, our datacenter, and our employees and assigns from any and all damages alleged tto be related to the use, misuse, or unavailability of the service and the underlying software.

ACCEPTABLE USE POLICY

SpamFilteredForms.com's service is intended as a means of providing email access to subscribers, most of  whom are assumed to be businesses or professionals, by members of the general public. Use of the service in connection with illegal activities is prohibited, as is linking from any site that communicates anything defamatory, threatening, hateful, harassing, abusive, unlawful, vulgar, obscene, harmful or potentially harmful, or invasive of anyone's privacy.

Every standard SpamFilteredForms.com user account is linked to a particular email address. This address may be the property of a sole individual, or it may belong to a business or organization. By subscribing to this service, you warrant that you have the right to receive email at the address you provide.

EFFECTIVENESS OF THE SERVICE

By subscribing to or using the service, you acknowledger that no spam filtration system is perfect, and that occasional unsolicited commercial messages may be sent despite the best efforts of SpamFilteredForms.com to filter out these messages. You also acknowledge that from time to time, legitimate messages may be tagged as "spam" and discarded. You agree that SpamFilteredForms.com shall bear no liability for either "spam" messages that are sent, or legitimate messages that are discarded.

SpamFreeText makes no warranties or representations regarding the service, and specifically disclaims any and all warranties, including (but not limited to) the warranty of fitness for a particular purpose and warranty of merchantability. By using the service, a user accepts the service on an "as-is, with all faults" basis.

RELIABILITY AND AVAILABILITY OF THE SERVICE

Although SpamFilteredForms.com seeks to maintain continuous availability, we com make no warranty as to the availability of the service at any given moment in time. By subscribing to or using this service, you agree that occasional outages due to scheduled or unscheduled maintenance, network outages, equipment failure, or other reasons may occur from time to time, and that SpamFilteredForms.com bears no liability for any damages, including incidental or consequential damages, that may be alleged to have been caused by any downtime event.

You also acknowledge that SpamFilteredForms.com has no control over how email messages are handled by your Internet provider, domain server, or other providers; and that message delivery may be affected by numerous factors beyond the control of SpamFilteredForms.com.

In addition, you acknowledge that software used by your ISP, Web hosting provider, domain administrator, or other service handling your email may add an additional layer of filtering to your mail, which may result in false positives after your mail is sent from our servers.

LIMITATION OF LIABILITY

You agree that under no circumstances shall SpamFilteredForms.com be liable to users for any damages, including (but not limited to) incidental, consequential or special damages; and you covenant and agree that your damages shall be limited to a prorated refund of sums paid by you for the use of the service, if any.

PROPRIETARY SOFTWARE

This service uses proprietary, server-based software to carry out its spam-filtering and  message-mailing functions. As part of your subscription, we grant you  a revocable, non-exclusive, non-transferable license to use the Software and any future corrections, updates and upgrades.

The software may contain copyrighted material, trade secrets, patents, and/or other proprietary information owned by SpamFilteredForms.com or RJM Web Design. You may not de-compile, reverse engineer, disassemble, attempt to discover any source code or underlying ideas or algorithms of the software, modify, rent, lease, loan, reproduce, sublicense or distribute copies of, or otherwise transfer the software to any third party, nor  attempt to access the software except via the Web-based forms provided by SpamFilteredForms.com. By granting you a license to use the software, we are not granting you any title or rights of ownership in the software.

ASSUMED RISKS

You agree that SpamFilteredForms.com cannot guarantee or warrant that messages sent to you will be free of defects, corruption, or infection with viruses, worms, Trojan horses or other malicious code that may have destructive properties, compromise your security, or damage your equipment. You also understand that the Internet is not secure, and that a possibility exists for interception of email messages at any stage of transmission.

PRIVACY POLICY

In order to evaluate messages, filter out "spam," and process submitted messages, SpamFilteredForms.com automatically collects considerable information about every computer that attempts to connect to our service. The exact nature of the information collected is a trade secret because this information is used as part of our spam-filtering technology, but none of it allows us to identify a particular individual.

In addition to automatically collected  information, SpamFilteredForms.com also collects whatever information is voluntarily entered by users when submitting a message. We collect this infomation in order to send the message to its intended recipient. Except when troubleshooting a problem, we do not access any of the information entered in contact forms nor use it for any purpose once the message has been sent.

Unless required to by law or court order, we do share share subscriber or sender information with any parties other than those who require this information to provide the service, troubleshoot problems, investigate abuse, or process subscribers' payments.

ADVERTISING

With respect to the free service, you acknowledge and agree that SpamFilteredForms.com is advertising-supported, and that advertising may be placed on any and all pages of the site, at the sole discretion of the Webmaster. You agree that any and all advertising revenues are the sole property of SpamFilteredForms.com and its owner(s), and that you have no share or entitlement to same.

REGULATORY COMPLIANCE

These Terms of Service notwithstanding, you acknowledge that SpamFilteredForms.com is obligated to comply with all relevant laws, rules, regulations, and orders pertaining to electronic data  communication, recordkeeping, and preservation of data.

CHOICE OF LAW, VENUE

Any disputes arising out if the use of SpamFilteredForms.com shall be adjudicated through binding arbitration, with arbitration conducted under the Commercial Arbitration Rules of the American Arbitration  Association. Arbitration hearings shall be conducted in the State of  New York, County of Queens, and the substantive law of the state of New York shall control.
